1. Introduction and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and PredictX Technologies Private Limited ("PredictX," "Company," "we," "us," or "our"), governing your access to and use of the PredictX platform, including our mobile application, website, APIs, and all related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Risk Disclosure, Community Guidelines, and Responsible Play Policy.

We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification and/or email at least fifteen (15) days before taking effect. Your continued use of the Platform after such notice constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least eighteen (18) years of age to create an account and use the Platform. By registering, you represent and warrant that you meet this age requirement.

The Platform is available to users in jurisdictions where skill-based prediction games using virtual tokens are lawful. You are solely responsible for determining whether your use complies with the laws of your jurisdiction. The Platform is not available to residents of jurisdictions where prediction games are explicitly prohibited by law, including the Indian states of Andhra Pradesh, Assam, Nagaland, Odisha, Sikkim, and Telangana.

3. Account Registration and Security

To use the Platform, you must create an account by providing a valid mobile phone number and completing OTP verification. You may also register using Google OAuth.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must not:

• Share your account with any other person
• Create or control more than one account per individual
• Use automated tools, scripts, or bots to interact with the Platform

We employ device fingerprinting, phone verification, and behavioral analysis to detect and prevent multi-accounting. Violation results in immediate suspension and forfeiture of all virtual tokens.

4. Platform Description and Game Mechanics

PredictX is a skill-based prediction game that allows users to make probability predictions on live events (initially cricket matches) using virtual tokens. PredictX is not a gambling, betting, or wagering platform.

Prediction Mechanics:

• Users commit tokens to prediction outcomes (YES/NO) on available markets
• The Platform operates a parimutuel pool model: all token commitments are pooled, and upon resolution, the pool (minus a 5% platform fee) is distributed proportionally among correct predictors
• Markets are resolved based on verified real-world outcomes from authoritative data sources
• New users receive 1,000 virtual tokens upon registration
• A daily spending cap of 10,000 tokens applies globally across all predictions and groups

Groups: Users may create or join groups for social prediction experiences. Groups are filtered views of global markets — group predictions still participate in the global pool. Group-specific leaderboards track relative performance among members.

5. Acceptable Use Policy

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law
• Engage in collusion, match-fixing, insider trading on markets, or manipulation of prediction outcomes
• Use bots, scripts, or automated tools to interact with the Platform
• Attempt to exploit bugs, vulnerabilities, or system errors
• Engage in multi-accounting, account farming, or referral abuse
• Circumvent daily spending limits, self-exclusion measures, or other safeguards
• Harass, threaten, defame, or abuse other users
• Post or distribute spam, malware, or malicious content
• Reverse-engineer, decompile, or scrape any part of the Platform

6. Intellectual Property

All content, features, software, designs, text, graphics, logos, and trademarks on the Platform are owned by or licensed to PredictX. Cricket match data is sourced from licensed third-party providers. IPL team names and logos are trademarks of their respective owners.

By posting content to the Platform (including group chat messages, predictions, and profile information), you grant PredictX a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content in connection with operating the Platform.

7. AI-Powered Features

The Platform uses AI and machine learning to structure prediction markets and provide insights. AI-generated content is provided for informational and entertainment purposes only. It is not financial, investment, or professional advice. You acknowledge that all prediction decisions are made by you alone, and you are solely responsible for your choices.

8. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. PREDICTX DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PredictX does not warrant that the Platform will be uninterrupted, secure, or error-free. In cases of market ambiguity, data-source conflict, or technical failure, PredictX reserves the right to void a market and refund committed tokens proportionally.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREDICTX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. PredictX's total aggregate liability for all claims shall not exceed the greater of (a) what you paid to PredictX in the twelve (12) months preceding the claim, or (b) USD 100.

10. Suspension and Termination

We may suspend or terminate your account at any time for breach of these Terms, suspected fraudulent activity, failure to meet eligibility requirements, or changes in applicable law. You may terminate your account by contacting support@thepredictx.com. Upon termination, all virtual tokens are forfeited.

11. Dispute Resolution

Before initiating formal proceedings, you agree to contact PredictX at legal@thepredictx.com and attempt to resolve any dispute informally within thirty (30) days.

For users in India: Disputes shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). Seat: Bengaluru, India.

For users outside India: Disputes shall be settled by arbitration under SIAC rules. Seat: Singapore.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS, NOT IN A CLASS ACTION.

12. Governing Law

For users primarily accessing the Platform from India, these Terms are governed by the laws of India. For users outside India, these Terms are governed by the laws of Singapore.

13. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, Risk Disclosure, Community Guidelines, and Responsible Play Policy, constitute the entire agreement.
• Severability: If any provision is found invalid, the remaining provisions continue in full force.
• Force Majeure: PredictX is not liable for failures due to causes beyond its reasonable control.
• Language: These Terms are drafted in English. In any conflict between translations, the English version prevails.
